ANPD launches public consultation to revise regulatory agenda in light of new responsibilities introduced by the Digital Child and Adolescent Statute (ECA Digital)

On October 17, 2025, the Brazilian Data Protection Authority (ANPD) announced the opening of a public consultation aimed at reviewing its regulatory agenda for the 2025–2026 biennium. The initiative follows the expansion of the Authority’s responsibilities under the recently enacted Digital Child and Adolescent Statute (ECA Digital), which designates an administrative body to safeguard the rights of children and adolescents in the digital environment. ANPD releases study on age-assurance mechanisms in digital environments

On October 14, 2025, the Brazilian National Data Protection Agency (ANPD) published the fifth edition of its Radar Tecnológico series, dedicated to the topic of age-assurance mechanisms in digital environments. Prepared by the Agency’s General Coordination for Technology and Research (CGTP), the study provides a comprehensive overview of document-based, biometric, and cryptographic approaches for verifying or estimating users’ ages. It examines the implications of these technologies for privacy and personal data protection of children and adolescents, in accordance with the General Data Protection Law (LGPD) and the Digital Child and Adolescent Statute (Law No. 15,211/2025). STJ holds banks liable for losses caused by digital fraud and scams

On October 21, 2025, the Third Panel of Brazil’s Superior Court of Justice (STJ) ruled that banks and payment institutions must compensate consumers who suffer financial losses due to online scams, when security deficiencies, failures in detecting unusual transactions, or ineffective fraud-prevention measures are identified. The case concerned a customer deceived into believing he was speaking with his bank’s official support, which led to unauthorized loans and high-value transfers. Learn more.

CGI.br releases 2025 edition of the TIC Kids Online Brazil survey

On October 22, 2025, the Brazilian Internet Steering Committee (CGI.br), through the Regional Center for Studies on the Development of the Information Society (Cetic.br/NIC.br), released the 2025 edition of the TIC Kids Online Brazil survey. The study examines how children and adolescents aged 9 to 17 use the internet, focusing on online behavior, safety, and content consumption. Findings show that this audience engages more with content created by digital influencers than with films or series, including videos containing advertising and gambling promotions. Learn more.
