Digital Statute for Children and Adolescents is enacted

On September 17, 2025, Law No. 15,211/2025 was enacted, establishing the Digital Statute for Children and Adolescents, derived from Bill No. 2628/2022. The statute imposes obligations on products and services targeted at or likely to be accessed by children and adolescents, aiming to prevent risks such as exposure to harmful content and to ensure priority protection in digital environments. Certain provisions were vetoed, including the assignment of competence to Anatel for forwarding blocking orders, due to a legislative initiative flaw, and the article establishing a one-year vacatio legis, deemed incompatible with the urgency of the matter. Government proposes regulation of large digital platforms

On September 17, 2025, the Federal Government submitted to the House of Representatives a bill addressing the economic and competition regulation of large digital platforms. The proposal amends Law No. 12,529/2011, establishing administrative proceedings within the Administrative Council for Economic Defense (Cade) to designate certain entities as “systemically relevant platforms.” These entities are defined by criteria such as market power associated with network effects, vertical integrations in adjacent markets, and a minimum turnover of BRL 5 billion annually in Brazil and BRL 50 billion globally. Once designated, such platforms will be subject to specific duties and obligations aimed at fostering competition in digital markets. Learn more.

Provisional measure creates tax incentives for datacenter infrastructure

On September 18, the Federal Government enacted Provisional Measure No. 1,318/2025, establishing the Special Tax Regime for Datacenter Services (REDATA). The regime suspends federal taxes such as PIS/Pasep, Cofins, IPI, and Import Tax on the purchase of components used for the installation or expansion of datacenter services in Brazil. To qualify for the benefit, companies must allocate at least 10% of their processing and storage capacity to the domestic market and invest in research, development, and innovation equivalent to 2% of the value of incentivized acquisitions. Salary Transparency Report must be published by over 54,000 companies by September 30

The Ministry of Labor and Employment (MTE) has made the Salary Transparency and Remuneration Criteria Report available to more than 54,000 companies with 100 or more employees, as required by the Equal Pay Law (Law No. 14,611/2023). Companies must publish the report by September 30 on their institutional channels and register it on the Emprega Brasil portal, ensuring broad public visibility and access. Publication can occur on corporate websites, social media, or equivalent means, provided it is easily accessible. Learn more.

Brazil’s Federal Revenue aligns fintechs with banks in anti–money laundering rules

The Federal Revenue Service has aligned fintechs with financial institutions regarding the obligation to provide information aimed at curbing crimes such as money laundering. The normative instruction, published in the Official Gazette on August 29, 2025, was announced after three major operations against organized crime that uncovered a scheme that allegedly moved about BRL 140 billion illegally, with more than 400 court orders executed in at least eight states. The rule requires payment institutions and participants in payment arrangements to follow the same ancillary obligations of the National Financial System and the Brazilian Payments System related to the e-Financeira, a report that consolidates high-value transactions, and it mandates reporting indications of criminal activity to the authorities. Bill proposes mandatory alerts in chatbots and AI systems for suicide and self-harm prevention

On September 1, 2025, Bill No. 4348/2025 was introduced, proposing amendments to Law No. 13,819/2019 to mandate the issuance of preventive alerts by chatbots and artificial intelligence (AI) systems. The initiative requires digital platforms to provide messages of support and guidance when interactions related to mental health, self-harm, or suicide are identified. The bill extends the National Policy for the Prevention of Self-Harm and Suicide into the digital environment, aiming to enhance user protection and immediate assistance. Learn more.

Provisional measure converts ANPD into a regulatory agency

On 17 September, the Federal Government issued Provisional Measure No. 1,317/2025, which transforms the National Data Protection Authority (ANPD) into a regulatory agency. With this change, the entity will be renamed the National Data Protection Agency, a special-purpose autonomous authority linked to the Ministry of Justice and Public Security, with functional, technical, decision-making, administrative, and financial independence.
