The U.S. Copyright Office has released Part 2 of its Report on copyright and artificial intelligence (AI), focusing on the copyrightability of outputs created by generative AI. The report affirms that existing copyright law principles are adaptable to this emerging technology, as they have been with past innovations. It states that AI-generated outputs can be protected by copyright only when a human author contributes sufficient creative elements, such as perceptible human-authored work or modifications. Simply providing prompts to AI does not qualify. The report also confirms that AI-assisted creation or inclusion of AI-generated content in human-created works does not affect copyright eligibility, and no changes to current laws are needed to extend protection to AI outputs.
