Brazil’s Ministry of Justice and Public Security has released a report compiling 70 submissions received during a public consultation on online age-verification mechanisms. The consultation forms part of the regulatory process for the Digital Statute of the Child and Adolescent (ECA Digital), established by Law No. 15,211/2025. The report was prepared by the National Secretariat for Digital Rights, with academic support and input from authorities including the National Consumer Secretariat and the National Data Protection Authority (ANPD). The contributions will inform the drafting of the implementing decree, currently under joint review by multiple federal agencies, ahead of the law’s entry into force in March.

According to the report, there is broad agreement that self-declaration of age is insufficient in higher-risk online environments. However, respondents generally opposed adopting a single, uniform rule for all digital services. Most submissions advocate for a risk-based approach, calibrating verification requirements according to the nature and risk profile of each platform. Interoperability between systems, prior testing of regulatory standards, and data minimization were also frequently highlighted. The consultation revealed differing views on who should be responsible for providing age-verification solutions and how to define the degree of risk associated with specific applications. The report further notes concerns regarding practical implementation and potential privacy risks, including data breaches and the exclusion of users with limited access to technology or identification documents. The ANPD will be responsible for issuing technical guidance, setting compliance standards, and establishing transition deadlines, with the stated objective of ensuring legal certainty and operational feasibility as the new requirements are introduced into Brazil’s digital environment.
