On June 13, 2025, the Brazilian Patent and Trademark Office (INPI) published Ordinance INPI/PR No. 10/2025, which approves a new Fee Schedule for industrial property services. The new values will take effect on August 7, 2025, with increases ranging from 30% to 49% across most fees — the first update since 2012.

The change directly affects services related to trademarks, patents, industrial designs, and computer programs, and requires immediate attention from rights holders and companies. IP law firms and consultants should act swiftly to advise clients, anticipate filings, and review protection strategies while current fees are still valid.

Financial Impact and Key Deadline: August 6 Is the Cutoff Date

All filings and payments made on or after August 7, 2025 will be subject to the updated fee schedule. Therefore, any applications, appeals, renewals, annuity payments, and other actions that can be anticipated should be submitted by August 6 at the latest.

The most impacted services — both in frequency and cost — include:

  • Trademark and patent applications

  • Response to office actions

  • Renewal and annuity payments

  • Appeals, oppositions, and administrative challenges

Discounts Preserved for Specific Categories

The ordinance maintains a 50% discount for the following categories, upon submission of supporting documentation:

  • Individuals not engaged in business activity

  • Sole proprietors, microenterprises, and small businesses

  • Startups (as defined under Complementary Law No. 182/2021)

  • Scientific and technological institutions (ICTs)

  • Nonprofit entities

  • Brazilian public administration bodies (federal, state, or municipal)

Additionally, people with disabilities and those in economically vulnerable situations will continue to receive a 100% exemption on initial filings.

New Procedures and Strategic Opportunities

The updated regulation also introduces restructured services and new procedural categories, which may offer cost-effective or strategically advantageous alternatives for both new filings and existing IP portfolios.

As the new schedule approaches, law firms and IP professionals are encouraged to:

  • Review and organize pending actions for all clients

  • Evaluate opportunities to advance filings or payments

  • Identify clients eligible for discounts or exemptions

  • Update internal budgets and IP protection timelines

  • Strengthen communication with clients regarding the impacts and strategic options under the new rules

Ordinance INPI/PR No. 10/2025 marks a significant regulatory shift and highlights the need for proactive engagement by IP professionals. More than a fee adjustment, this is an opportunity to reassess protection strategies and reinforce the advisory role of legal and technical teams in managing intellectual property assets.
