On February 5, 2026, during a public hearing held by the Superior Electoral Court to discuss the regulatory framework for the 2026 General Elections, Regional Federal Prosecutor Luiz Carlos Gonçalves proposed the imposition of fines of up to BRL 30,000 for the dissemination, in electoral advertising, of fabricated or manipulated disinformation, including content generated through artificial intelligence. According to the prosecutor, the proposal is intended to address a regulatory gap in the current electoral regime.

The proposal was examined in the context of draft regulations released in January 2026, which received a record 1,431 submissions. Key suggestions presented during the hearings include enhanced transparency and accountability requirements for digital platforms and AI systems, clearer definitions of synthetic media and deepfakes, and strengthened liability mechanisms. The proposals will undergo technical review and subsequent deliberation by the Court’s Plenary, with final rules required to be approved by March 5, 2026.
