This measure is based on the latest scientific evidence and a regulatory history dating back to 2009. The use of any smoking device remains prohibited in enclosed public spaces under Law 9.294/1996. Anvisa is committed to periodically reviewing the technical literature on the topic and accepting new scientific data for analysis.
The new resolution also introduces stringent enforcement measures and penalties, including warnings, fines, and even the closure of establishments that violate the rule. The illegal sale of e-cigarettes should be reported to local Health Surveillance Authorities. Anvisa also plans to conduct systematic reviews on the topic and considers the submission of scientific studies as part of the regulatory process. The measure aims to safeguard public health and ensure strict compliance with the legislation.
