On 28 November 2025 the Brazilian National Data Protection Authority opened a Public Consultation aimed at identifying and clarifying interpretative doubts regarding terminology used in the newly enacted Digital Child and Adolescent Statute (ECA Digital, Law 15.211 of 2025). The initiative seeks to map expressions that may generate ambiguity and hinder the safe and consistent application of the law, particularly in light of LGPD provisions on the processing of children’s and adolescents’ personal data. Contributions may be submitted until 12 December 2025 through the Brasil Participativo platform.

According to the Head of Standard-Setting, Rodrigo Santana, the consultation is intended to guide data controllers, technology providers and other stakeholders on concepts whose lack of precision could affect the effectiveness of the protections established by the ECA Digital. The scope is strictly limited to terminological questions, excluding procedural or operational aspects. The ANPD highlights that this is an opportunity for broad public engagement to enhance the technical understanding of the law and support its implementation for the protection of minors in digital environments.
