The Brazilian Data Protection Authority (ANPD) has launched an enforcement action targeting major companies that allegedly failed to appoint a Data Protection Officer (DPO) as required by Brazil’s General Data Protection Law (LGPD). The investigation also includes organizations that have purportedly not provided effective communication channels for data subjects, hindering the exercise of rights such as access, correction, and deletion of personal information.

This initiative is part of the ANPD’s Monitoring Cycle, aimed at ensuring transparency and the protection of personal data, with a focus on legal compliance. According to the ANPD’s General Coordinator of Oversight, the absence of a DPO or an efficient communication channel harms data subjects and impairs the Authority’s ability to enforce compliance with the LGPD.

The measure involves companies from various sectors, including technology, telecommunications, and healthcare, and aims not only to address irregularities but also to reinforce transparency in data processing practices. If the issues are not resolved, the companies may face administrative sanctions such as fines and warnings.
