The President of Brazil’s Chamber of Deputies, Hugo Motta (Republicanos-PB), is expected to soon forward Bill 2338/23 for discussion. Approved by the Senate last December, the bill—introduced by former Senate President Rodrigo Pacheco (PSD-MG)—aims to regulate artificial intelligence in Brazil. At the request of the Workers’ Party (PT), Motta is considering forming a working group to analyze and potentially revise the proposal. The bill was debated in a public hearing hosted by the Coalizão Direitos na Rede on March 14.
The proposal categorizes AI systems based on their risk to human life and fundamental rights, distinguishing between general AI and generative AI. It bans high-risk systems such as autonomous weapons and predictive profiling technologies, and restricts the use of facial recognition in public areas to very specific cases. Civil society groups have proposed updates, including mandatory governance measures and risk assessments for all AI applications.
