On August 15 (Tuesday), the Brazilian Data Protection Authority (ANPD) opened a public consultation regarding the guidelines on international data transfers affecting personal data.
The guidelines are intended to regulate the grounds for an adequacy decision and propose standard contractual clauses and binding corporate rules that allow international transfer.
Aligned with the European Union standard, it defines that collection carried out by a foreign company is not an international transfer automatically. International transfers are characterized by data shared between a Brazilian (exporter) and a foreign (importer) organization.
The public consultation will be available for comments by any interested party until September 14, 2023, through the “Participa Mais Brasil” platform.
Soon, more information will be released about a public hearing (virtual format) to be held by the ANPD for the result presentation and discussion of specific isssues.
