Brazil’s Electoral Court Approves New Rules for the Use of AI in the 2026 Elections; Learn More

Brazil’s Superior Electoral Court (TSE) has approved new rules governing the use of artificial intelligence in the 2026 elections, aiming to reduce the risks of disinformation and digital manipulation during campaign periods. The measures are part of a broader set of resolutions that will guide the electoral process, with the first round scheduled for October.

Among the main provisions is the restriction on the dissemination of synthetic content generated by AI within the 72 hours preceding and the 24 hours following Election Day, particularly when such content involves the image, voice, or statements of candidates or public figures. The regulation also requires clear labeling of AI-generated content and imposes additional obligations on digital platforms to remove irregular materials.

The initiative reflects the Electoral Court’s growing concern over the use of deepfakes, manipulated content, and automated tools capable of influencing public debate and voter behavior.

According to Juliana Sene Ikeda, partner at Campos Thomaz Advogados, the measure represents an important step toward adapting the electoral system to technological advances. “The regulation seeks to balance freedom of expression, technological innovation, and the protection of the democratic process. The challenge will be ensuring transparency and accountability without undermining the legitimate use of these tools,” says the technology and digital regulation specialist.

Juliana also notes that the 2026 elections are likely to serve as a testing ground for new forms of digital governance, particularly in the relationship between platforms, campaigns, and electoral authorities. “Artificial intelligence in the political environment is expected to gain increasing regulatory prominence in the coming years,” she adds.
