Justice Cristiano Zanin of Brazil’s Federal Supreme Court (STF) has scheduled a new conciliation hearing for May 11 at 2:00 p.m. in Direct Action of Unconstitutionality (ADI) No. 7788, which challenges two resolutions issued by the National Health Surveillance Agency (Anvisa) concerning the advertising of food products and medicines. The decision follows a joint request by the Office of the Attorney General (AGU) and the Brazilian Association of Radio and Television Broadcasters (ABERT), seeking additional time for negotiations on the grounds that discussions have not yet reached a sufficiently defined framework for settlement. The hearing had originally been set for February.
The dispute centers on Resolution RDC No. 24/2010, which requires health warnings in advertising campaigns for foods high in sugar, fat, and sodium, and Resolution RDC No. 96/2008, which regulates pharmaceutical advertising by allowing promotion only of over-the-counter medicines and establishing specific requirements and restrictions. The claimant association argues that the rules unduly restrict economic activity, while Anvisa maintains that the measures are aimed at safeguarding public health. The extension is intended to facilitate a negotiated solution, which may subsequently be submitted to the Supreme Court for approval.
