On Monday (June 9), Brazil’s National Data Protection Authority (ANPD) released the fourth volume of its Radar Tecnológico series, focusing on neurotechnologies. Conducted by the General Coordination of Technology and Research (CGTP), the study delves into the topic by mapping emerging applications and possible uses. A key concern raised is the sensitivity of neural data, which can reveal mental states, emotions, and mental health information—posing significant ethical and legal challenges.
In addition to outlining privacy and data protection risks, the study links these innovations to key principles of Brazil’s General Data Protection Law (LGPD), such as purpose limitation, adequacy, and necessity. This publication marks ANPD’s first step toward regulatory reflection on neurotechnology, highlighting the need for strategies that balance innovation with the protection of fundamental rights.
