MTE Ordinance No. 1,419/2024 introduced significant changes to Regulatory Standard No. 1 (NR-1), requiring the inclusion of psychosocial risk management in companies’ Risk Management Program (PGR), effective from May 26, 2025. This measure broadens the scope of occupational health and safety by incorporating factors such as harassment, emotional overload, exhausting work hours, and toxic organizational environments. It also increases the responsibility for the proper handling of personal data and compliance with the LGPD. The main goal is to prevent workers’ mental health issues and promote a healthier work environment.

Companies will need to adopt strict measures to identify, assess, and mitigate psychosocial risks. This includes implementing harassment prevention policies, mental health training, psychological support, and promoting a collaborative work environment. Inspections will be carried out by Ministry of Labor and Employment (MTE) auditors, and non-compliance may result in fines and public civil actions. Compliance with the new requirements not only ensures legal conformity but can also be a competitive advantage, contributing to employee well-being and productivity. The team at Campos Thomaz Advogados is available to guide companies through the necessary adaptations.
