The Board of Directors of the National Data Protection Authority (ANPD) denied the administrative appeal filed by Tools For Humanity (TFH), the company behind the World ID project, maintaining the suspension of financial compensation (in cryptocurrency or any other format) for digital identities created through iris scanning in Brazil. TFH had requested an additional 45-day period to adjust the app and halt the financial compensation offer, but the request was denied. The Board concluded that the suspension could be implemented by other means, such as postponing appointments until the necessary changes are made.

The decision, which strengthens ANPD’s role in protecting individuals’ informational self-determination, was based on the understanding that the financial compensation offered by TFH interferes with the free will of data subjects, who often authorize iris scanning due to immediate financial needs. In line with ANPD’s previous guidelines, the company has 10 business days to submit a formal declaration confirming the suspension of financial compensation. The measure demonstrates a view of the authority that the holders presumably do not have the capacity to freely exercise the free expression of will, even with available information about the risks, prevailing in this case the protection of fundamental rights of privacy and the security of personal data in Brazil.
