The National Justice Council (CNJ) Approves New Rules for the Use of Artificial Intelligence (AI) in the Judiciary
New Rules for Using AI in the Judiciary – Find What’s Changing!
The objective of the Resolution
The proposal establishes how AI will be used at all levels of the Judiciary, ensuring compatibility with the fundamental rights outlined in the Constitution.
Use of AI
Artificial intelligence will serve as an auxiliary and complementary tool in decision-making but will never act autonomously. The final decision will always rest with the judge.
Security and Privacy
The resolution mandates protecting legal security and complying with the General Data Protection Law (LGPD) when using AI.
Examples of AI Use in the Judiciary
- Assisting with questions during hearings.
- Helping identify contradictions in testimonies.
- Classifying cases and organizing legal arguments.
- Issuing alerts on legal precedents.
AI will help reduce delays in the Judiciary.
What AI CAN NOT Do
- Replace human review of data.
- Make judgments about a person’s personality or behavior.
- Classify or rank individuals based on their behavior or social status.
National AI Committee
A National Artificial Intelligence Committee, consisting of 13 members, will be established within the judiciary to ensure the security and ethical use of AI.
Important!
AI will not replace judges! It will be a tool to optimize their work, but humans will always make the final decision.
